Good morning, I hate to be the bearer of bad news, but in many cases the government is immune from lawsuits in which people have suffered monetary damages. That being said an attorney might be able to bring suit for restoration of funds for fayed which would hopefully bring back e-bullion so that we can recoup or earnings and profit. Glo I will talk with cousin this weekend and see if there is anything that we can do legally and if so if he knows of someone in California who we could contact. I just find it hard to believe that Fayed's attorney can't get things handled faster. The longer this goes the greater losses we have. The FED probably thinks we are terrorist funneling money. I don't kno what the answer is other than Costa Rica is looking good as a new place to call home. Papalodell

Hi all, I do not think it is different in the USA, than in Europe. To get a date from the judge after entering a motion, can take a month, in some places even longer. This is not up to the attorney but up to the judge. Do not forget that the judge has not only one case on his agenda. I know it is hard to wait, but I truly believe that this will be resolved to our satisfaction. We just have to be patient, and try to get as much information as we can about this case. Nothing gets ever resolved in a short time, and the more complicated the case the longer it takes. But please keep the faith. Chris

This is not up to the attorney but up to the judge. Do not forget that the judge has not only one case on his agenda. I know it is hard to wait, but I truly believe that this will be resolved to our satisfaction. We just have to be patient, and try to get as much information as we can about this case. Nothing gets ever resolved in a short time, and the more complicated the case the longer it takes. But please keep the faith.

Good Morning, Glo, Proof, Chris,and others, I talked with cousin/judge at length on this situation and even had him read threw our post and news we have been able to find. His opinion is that this has fallen under the homeland security act which is a very gray area as to FEDS power. He said otherwise, the law of the land would have to have been followed, which meant only the IRS would have been able to freeze the accounts. One question he asked is if Fayed a US citizen which I do not know answer. Reason for asking is that it would give prosecutor strength in argument about flight risk. His suggestion is to be patient and see what happens in the next 2 to 3 weeks. In the meantime he will do some research and see if and what our rights are. Have a blessed day, Papalodell

He has not been charged in that case. I don't think we contacted the wrong attorney. If there are two, they work together. But Mr Spertus was the one on the motion, the last motion which is the important one. Maybe one is a criminal attorney and one a commercial one, for business matters. Chris

Dunno if anyone here has seen the latest EB news, hefre it is: http://www.dgcmagazine.com/blog/?p=253 According to the posting in the blog James Fayed's lawyer is petitioning the court to release him so that he can continue to run his businesses based on the argument that the prosecution's reasoning was faulty and the judge's assessment to hold him is not valid. The entire 51-page document is posted there, with what seems to be a court date of Sept 10th.

Here are some news: On Friday, August 29, 2008 there will be a federal court status conference, due to the motion, entered by Mr. Fayeds attorney, saying that Mr. Fayed is detained without a bond incorrectly and needs to be released. Hopefully they release him soon, and grant him the second motion, which ask the judge that the FBI releases funds, to get the servers and the website back up again.
If this happens, it still will be impossible to withdraw funds, since the FBI and IRS seized them, but at least we will be able to access the site, which is a first step. The next step will probably not happen until after the trial, if Fayed wins that one, if not we really need to do a class lawsuit against the US Government, because they will be holding the money, and that could take a long time. So lets hope Fayed wins the trial. Chris

Chris I'm with you Chris, in my estimation the simpler the better! Many investors have lost over 20,000 with this fiasco, not nearly what admins have lost, but it has been a definite step backwards for us ALL in the name of JUSTICE???????!

Hi All, One of my friends received a check from e-bullion which was requested just before the fiasco with E-bullion. When he tried to deposit it to his bank of america account he was told that they cannot process. Has anyone had this experience and if so is there any suggestion? Thanks.
